(1) There shall be a Water and Sanitation Service Tariff Determination Commission to determine the fees to be paid by the consumers receiving such services for the provision of water and sanitation services. (2) In the commission as per sub-section (1): the following shall be the chairman and members:- (a) from among the persons who have obtained at least a master's degree in engineering, management, economics or financial management from a recognized educational institution and have acquired at least ten years of experience in taking managerial responsibilities in the relevant public institutions A person appointed by the Government of Nepal - Chairman (b) One member appointed by the Government of Nepal from among those who have obtained at least a bachelor's degree in economics, financial management, chartered accountancy or commerce from a recognized educational institution and have at least seven years of experience in the relevant field (c) From a recognized educational institution One "Member" appointed by the Government of Nepal from among those who have at least a bachelor's degree in Engineering, Sociology or Law and have at least seven years of experience in the relevant field. (3) According to sub-section (2), while appointing the chairman and members, at least one woman should be appointed.
(4) According to sub-section (2): The term of office of the chairman and members shall be four years and they may be re-appointed for one more term.
(5) Notwithstanding anything written in sub-section (4): if the chairman or member misbehaves or if his work is not satisfactory or if he does not fulfill his duties honestly according to his position or if he works against the interest of the Commission, the Government of Nepal may remove him at any time. However, before removing him in this way, he will have to be given a reasonable opportunity to present his justification.
